MINUTES

COUNTY COUNCIL MEETING

October 16, 2000

Spartanburg County Council met on Monday, October 16, 2000, in the County Council Chambers, 366 N. Church Street, Spartanburg, SC, at 5:30 p.m. The following attended: Honorable Karen Floyd, Chairman; Honorables David Britt, Jeff Horton, Frank Nutt, Ken Huckaby, and Rock Adams, Council Members; along with James K. Hartmann, County Administrator; Bill Dennis, Deputy County Administrator; Glenn Breed, Assistant County Administrator; and Billy Smith, Assistant County Attorney.

In compliance with the Freedom of Information Act, notice of this meeting was provided in advance to the local news media and other interested parties.

Chairman Floyd called the meeting to order.

Invocation was rendered by Dwayne Morris, Minister of Discipleship at First Baptist North Spartanburg. The Byrnes High School Airforce Jr. ROTC led in reciting the Pledge of Allegiance.

II.

No presentations scheduled.

III.

  1. Chairman Floyd declared open a Public Hearing in reference to a revised litter control ordinance, amending fees and fines. No one appeared in opposition. The Public Hearing was closed.
  2. Chairman Floyd declared open a Public Hearing in reference to proposed Ordinance amending Ordinance Number O-99-014 relating to the joint county industrial and business park (Park No. 2) of Cherokee and Spartanburg Counties so as to enlarge the park. No one appeared and the hearing was closed.
  3. Chairman Floyd declared open a Public Hearing in reference to SC Jobs Economic Development Authority proposed issuance of not exceeding $4,500,000 aggregate principal amount Economic Revenue Bonds (Southland Container Corp d/b/a Concept Packaging Group and Southland Leasing Co.) No one appeared and the hearing was closed.

Public Health and Human Services Committee (Honorable Johnnye Code Stewart, Chairman)

No items scheduled.

Personnel and Finance Committee (Honorable Ken Huckaby, Chairman)

  1. An Executive Session was held during Council Committee meetings relative to a personnel matter. No action taken.
  2. Motion by Mr. Huckaby to approve a $20 pay supplement for each poll manager working in the November 7, 2000, Presidential Election. Motion seconded by Mr. Horton and carried.
  3. Information was received regarding dental, life, and long-term disability insurance bids. No action was taken.
  4. Motion by Mr. Huckaby to approve the Administrator's request for two new management positions (Assistant County Administrator at a Grade 32 and a Budget Director at a Grade 32 or 33) to be funded for the remainder of this fiscal year through existing accounts. Motion seconded by Mr. Horton and carried.
  5. Updated financial data was received with no action taken.

Recreation Committee (Honorable Jeff Horton, Chairman)

  1. Information was received regarding the basketball courts at Cleveland Park. The Honorables Johnnye Code Stewart, Brenda Lee and Linda Dogan have visited the relocation site near the fairgrounds, have visited with neighbors, and agree that this is the best site, as long as the site includes a buffer, restrooms, fountains and benches.
  2. Mr. Jeff Caton provided a monthly progress report relative to Cleveland Park Renovation project.

Economic Recruitment and Development Committee (Honorable David Britt, Chairman)

  1. Motion by Mr. Britt to adopt a resolution authorizing the execution and delivery of an inducement agreement by and between Spartanburg County and TYCO Electronics Corporation whereby, under certain conditions, Spartanburg County will execute a lease agreement(s) for a project(s) involving not less than twenty million dollars ($20,000,000) investment. Motion seconded by Mr. Nutt and carried.
  2. Motion by Mr. Britt to render first reading by title to an Ordinance amending the terms of that certain lease agreement between Spartanburg County and Michelin North American, Inc., dated as of December 1, 1996. Motion seconded by Mr. Nutt and carried.
  3. Motion by Mr. Britt to render first reading by title to an Ordinance to amend the jointly owned and operated industrial/business park in conjunction with Union County; such park being geographically located in Union County and Spartanburg County and established pursuant to SC Code of Laws, as amended, to provide for a written agreement with Union County providing for the expenses of the park, the percentage of revenue application, and the distribution of fees in lieu of ad valorem tax to the counties and relevant taxing entities; and to provide that jobs tax credits allowed by law be provided for industries locating in said park, and to permit a user fee in lieu of ad valorem taxation. Motion seconded by Mr. Huckaby and carried.
  4. Motion by Mr. Britt to render first reading by title to an Ordinance authorizing the execution and delivery of a lease agreement between Spartanburg County as lessor and Alcoa Fujikura Ltd as lessee, and authorizing other matters relating to the lease agreement, including, without limitation, payment to Spartanburg County of a fee in lieu of taxes. Motion seconded by Mr. Huckaby and carried.
  5. Motion by Mr. Britt to adopt a Resolution in support of the issuance by the SC Jobs Economic Development Authority of its economic development revenue bonds (Concept Packaging Group Project) series 2000, pursuant to the provisions of title 41, Chapter 43, of the SC Code of Laws 1976 as amended, in the aggregate principal amount of not exceeding $4,500,000. Motion seconded by Mr. Horton and carried.

Public Safety and Judiciary Committee (Honorable Rock Adams, Chairman)

  1. Motion by Mr. Adams to issue a solicitation permit to the Knights of Columbus authorizing them to solicit funds from motorists at the intersection of Reidville Road and Anderson Mill Road and on Peachwood Center Drive on Saturday, October 21, 2000, and on Saturday, October 28, 2000, between the hours of 11:00 a.m. and 3:00 p.m. Motion seconded by Mr. Huckaby and carried.
  2. Motion by Mr. Huckaby to render first reading by title to an Ordinance amending Ordinance No. 641 as it relates to the EMS Advisory Committee. Motion seconded by Mr. Adams and carried.
  3. Motion by Mr. Britt to reduce the fees for appeals and variances from $200 to $100, and refund 50% of what has been collected in fees for appeals and variances since January of 2000. Motion seconded by Mr. Nutt and carried.
  4. Information was received regarding activities of the Building Codes Department. No action taken

Public Works, Buildings and Grounds Committee (Honorable Frank Nutt, Chairman)

  1. Information was received regarding a County-owned property project. No action taken.
  2. Information was received regarding activities of the Public Works Department. No action taken.

VI.

  1. Motion by Mr. Britt to render third reading to proposed amendments to Unified Land Management Ordinance, to include the amendment to fees for appeals and variances as outlined herein. Motion seconded by Mr. Nutt and carried.
  2. Motion by Mr. Britt to render third reading to revised Litter Control Ordinance, amending fees and fines. Motion seconded by Mr. Horton and carried.
  3. Motion by Mr. Britt to render second reading to a proposed Ordinance to amend Ordinance Number O-99-014 relating to the Joint County Industrial and Business Park (Park No. 2) of Cherokee and Spartanburg Counties so as to enlarge the park. Motion seconded by Mr. Nutt and carried.
  4. Motion by Mr. Britt to render second reading to a proposed Ordinance designating the J. Verne Smith Parkway and portion of Highway 101 as a scenic highway. Motion seconded by Mr. Huckaby and carried.

VII.

  1. Motion by Mr. Britt to render first reading by title to an Ordinance authorizing the execution and delivery of a fee in lieu of tax agreement by and among Spartanburg County, SC, and TYCO Electronics Corporation; and other matters relating thereto including, without limitation, payment of a fee in lieu of taxes. Motion seconded by Mr. Adams and carried.

 

VIII.

All resolutions, ordinances, agreements, petitions and related documents which were read and approved by Council at this meeting for the financing of certain industrial or similar revenue bonds or notes, are incorporated in these minutes by reference as if fully set forth herein. The reference is to all such documents showing execution by the County on the date of this meeting included in the office of the Clerk of Court for Spartanburg County.
