Public Safety and Judiciary Committee

March 19, 2001

The Public Safety and Judiciary Committee of Spartanburg County Council met on Monday, March 19, 2001, in Conference Room Two of the County Administrative Office Building. In compliance with the Freedom of Information Act, notice of this meeting was provided in advance to the local news media and other interested parties. The following were in attendance: Honorable Rock Adams, Chairman; Honorables Ken Huckaby and Frank Nutt, Committee Members; along with Karen Floyd, David Britt and Jeff Horton, Johnnye Code-Stewart, Council members. Also attending were James K. Hartmann, County Administrator; Bill Dennis, Deputy County Administrator; Glenn Breed, Assistant County Administrator; Chris Story, Assistant County Administrator, and Edwin Haskell, Assistant County Attorney.

    1. Chairman Adams called the meeting to order.
    1. Mr. Breed stated we have received information from Mayor of Lyman concerning an annexation in the Town of Lyman. It effects the Duncan Fire Service Area. This will require us to amend the boundaries of the Duncan Fire Service Area by Ordiance. Mr. Haskell advised we need to adopt two Resolutions calling for Public Hearings; one to diminish the annexed area of Duncan Fire Service Area and one to annex annexed areas into Tyger River Fire Service area. Motion made by Mr. Nutt. Motion seconded by Mr. Huckaby.
    2. Mr. Hartmann stated letter was received from Sandra Gowan, Town of Reidville Clerk, in reference to a request by the Town of Reidville to prosecute any of its cases in the Magistrate’s Court. Administration recommends approval of this request. Mr. Hartmann spoke with the Chief Magistrate about it, and he is in favor of it. All fines would revert to Spartanburg County. Move by Mr. Huckaby to grant this request to the Town of Reidville. Motion seconded by Mr. Nutt and carried.
    3. Mr. Hartmann stated we received a letter from the attorney representing the Town of Chesnee. They have elected to employee a municipal judge. We are required to consent to an order which would go to the Chief Justice in order for this to occur. Mr. Hartmann recommends we approve this request. All parties are in favor of this. Motion made by Mr. Nutt to approve the request. Motion seconded by Mr. Huckaby.
    4. Information was received regarding activities of the Building Codes Department with no action taken.
