September 16, 2002

Spartanburg County Council met on Monday, September 16, 2002, in the County Council Chambers, 366 N. Church Street, Spartanburg, SC, at 5:30 p.m. The following attended: Honorable Karen Floyd, Chairman; Honorables Jeff Horton, David Britt, Frank Nutt, Ken Huckaby, Johnnye Code Stewart and Rock Adams, Council Members; along with James K. Hartmann, County Administrator; Bill Dennis, Deputy County Administrator; Chris Story, Assistant County Administrator, Glenn Breed, Assistant County Administrator; and William McBee Smith, Assistant County Attorney.

In compliance with the Freedom of Information Act, notice of this meeting was provided in advance to the local news media and other interested parties.

Chairman Floyd called the meeting to order.

Invocation was rendered by Mr. Glenn Breed, Assistant County Administrator. Mr. Harold Osborne led in reciting the Pledge of Allegiance.

II.

  1. Motion made by Mr. Horton to adopt a Resolution expressing recognition and appreciation for the pride and honor bestowed upon Spartanburg County by the achievements of Walter M. "Bud" Moore. Motion seconded by Mr. Britt and carried.
  2. Motion made by Ms. Floyd to adopt a Resolution expressing recognition and appreciation for the dedicated services bestowed upon Spartanburg County by Julie Lowry and Les McMillan for their efforts on behalf of the restoration and revitalization of Cleveland Park. Motion seconded by Mr. Britt and carried.

Public Health and Human Services Committee (Honorable Johnnye Code Stewart, Chairman)

Personnel and Finance Committee (Honorable Ken Huckaby)

  1. Motion made by Mr. Britt to adopt a Resolution calling for a Public Hearing to be held upon the question of the issuance of not exceeding $8,000,000 of General Obligation Bonds of Startex-Jackson-Wellford-Duncan Water District and to provide for the publication of the notice of such hearing. Motion seconded by Ms. Stewart and carried.
  2. Motion made by Mr. Britt to render first reading to an Ordinance finding that Startex-Jackson-Wellford-Duncan Water District may issue not exceeding $8,000,000 General Obligation Bonds; to authorize Startex-Jackson-Wellford-Duncan Water District Commission to issue such bonds and to provide for the publication of notice of the said finding and authorization. Motion seconded by Mr. Adams and carried.
  3. Motion made by Mr. Britt to adopt a Resolution authorizing the County Council of Spartanburg County to publish a Notice of Public Hearing regarding whether it may be in the interest of the Hilltop Area Fire District for the Spartanburg County Council to authorize the Board of Fire Control to issue General Obligation Bonds of the district in the principal amount of not exceeding $850,000, and authorizing the form of such Notice of Public Hearing. Motion seconded by Mr. Adams and carried.
  4. Motion made by Mr. Britt to render first reading to an Ordinance authorizing the Board of Fire Control of the Hilltop Area Fire District to issue General Obligation Bonds in the principal amount of not exceeding $850,000 of the Hilltop Area Fire District; and other matters relating thereto. Motion seconded by Mr. Adams and carried.
  5. Motion made by Mr. Huckaby to adopt Personnel Policy Revision - Insurance Coverage After Retirement with one change. Personnel Committee recommended adopting the policy, but changing the provision that a person have at least ten continuous years of service with Spartanburg County to eight years, and the effective date of this revision will be October, 2002. Motion seconded by Ms. Stewart and carried.
  6. Motion made by Mr. Huckaby to award bid for advertisement of properties for Delinquent Tax Sale Notice to the Spartanburg Herald-Journal at $.79 per advertisement for a total approximate award of $11,000. Motion seconded by Mr. Nutt and carried.
  7. Information received in reference to FY02 Year-end Financial Closeout.

Recreation Committee – (Honorable Jeff Horton, Chairman)

  1. Information received in regard to Cleveland Park Renovation. Cleveland Park will be ready for Opening Ceremonies on Saturday, September 21 from 10:00 a.m. until 10:00 p.m. The park is looking great.
  2. Information received in regard to Va-du-Mar McMillan Park property. Road construction crews have been in place. Road is being completed.

Economic Recruitment and Development Committee – (Honorable David Britt, Chairman)

Public Safety and Judiciary Committee – (Honorable Rock Adams, Chairman)

  1. Motion made by Mr. Adams to approve a request from Knights of Columbus Council #6076 to solicit funds from motorists at the intersections of Reidville and Anderson Mill Roads, Blackstock Road and U.S. 29, Franklin Avenue and U.S. 29 and on Peachwood Center Drive on Saturdays, October 12, 2002, October 26, 2002, and November 9, 2002 (Rain Date) between the hours of 10:00 a.m. to 3:00 p.m. Motion seconded by Mr. Horton and carried.
  2. Motion made by Mr. Nutt to deny a request from Deeper Life Ministries to solicit funds from motorists at the intersection of 29 and Franklin and S. Blackstock Road on Friday and Saturday, October 25 and October 26. Motion seconded by Mr. Adams and carried. Request from Knights of Columbus was received first for the same location on the same date.
  3. Motion made by Mr. Huckaby to approve the Animal Redemption Fee authorized by Control Ordinance. The first offense will be $30 and will double thereafter. Motion seconded by Mr. Nutt and carried.
  4. Motion made by Mr. Adams to adopt the latest edition of the Spartanburg County Emergency Operations Plan. Motion seconded by Mr. Horton and carried.
  5. Information received regarding activities of the Building Codes Department.

Land Use Committee (Honorable David Britt, Chairman)

  1. Motion made by Mr. Britt to approve Woolpert, LLP Contract and Scope of Services for the permitting of NPDES Phase II Stormwater Regulations. Motion seconded by Mr. Huckaby and carried. Motion made by Mr. Britt to carryover request for approval to enter into Memorandum of Understanding with USCS Ecology Center, City of Spartanburg and other utilities for public education programs to see if we can have a larger scope of interest and more input. Motion seconded by Mr. Nutt and carried.

Public Works, Buildings and Grounds Committee (Honorable Frank Nutt, Chairman

  1. Information received regarding activities of the Public Works Department.

 

VI.

  1. Motion made by Mr. Huckaby to render second reading to a Budget Ordinance to the fiscal affairs of the Campobello Fire Service Area, the Chesnee Community Fire Service Area, the Cooley Springs-Fingerville Fire Service Area, the Cowpens Fire Service Area, the Cross Anchor Fire Service Area, the Duncan Fire Service Area, the East Greer Fire Service Area, the Enoree Fire Service Area, the Hobbysville Fire Service Area, the Inman Community Fire Service Area, the Town of Inman Fire Service Area, the Landrum Fire Service Area, the Poplar Springs Fire Service Area, the Tyger River Fire Service Area, the Woodruff Fire Service Area, making appropriations therefore, and levying taxes for the year beginning July 1, 2002 and ending June 30, 2003; to provide for budget control of said appropriations by the Spartanburg County Council; providing an effective date. Motion seconded by Mr. Adams and carried.
  2. Motion made by Mr. Britt to render second reading to an Ordinance amending the Unified Land Management Ordinance (Ordinance O-99-015). Motion seconded by Mr. Nutt and carried.

All resolutions, ordinances, agreements, petitions and related documents which were read and approved by Council at this meeting for the financing of certain industrial or similar revenue bonds or notes, are incorporated in these minutes by reference as if fully set forth herein. The reference is to all such documents showing execution by the county on the date of this meeting included in the office of the Clerk of Court for Spartanburg County.
