Spartanburg County Council met on Monday, June 16, 2003, in the County Council Chambers, 366 N. Church Street, Spartanburg, SC, at 5:30 p.m. The following attended: Honorable Jeff Horton, Chairman; Honorables Johnnye Code Stewart, Steve Parker, David Britt, Rock Adams, Ken Huckaby, and Frank Nutt, Council Members; along with James K. Hartmann, County Administrator; Bill Dennis, Deputy County Administrator; Glenn Breed, Assistant County Administrator; Roy McBee Smith, County Attorney; William McBee Smith, Assistant County Attorney; and Edwin Haskell, Assistant County Attorney.

In compliance with the Freedom of Information Act, notice of this meeting was provided in advance to the local news media and other interested parties.

Chairman Horton called the meeting to order.

Invocation was rendered by Chris Goethe, Bottom Line Ministry. Ms. Linda Dogan led in reciting the Pledge of Allegiance.

II.

  1. Motion made by Ms. Stewart to adopt a Resolution expressing recognition and appreciation for the pride and honor bestowed upon Spartanburg County by the dedicated services and generosity provided by Spartanburg County employees in the United Way Campaign. Motion seconded by Mr. Britt and carried. Ms. Linda Dogan, Planning Department, received Resolution.
  2. Motion made by Mr. Parker to adopt a Resolution recognizing June as National Homeownership Month. Motion seconded by Mr. Britt and carried. Mr. Daniel Zongrone, Housing and Construction Services Manager and Ms. Charlene McKanic, Housing Services Specialist, received Resolution.

    1. Chairman Horton declared open a public hearing to consider an Ordinance amending and restating Ordinance No. O-01-24 to provide for the issuance and sale of not exceeding fifteen million dollars ($15,000,000) General Obligation Bonds, Series 2003, of Spartanburg County, South Carolina, to prescribe the purposes for which the proceeds shall be expended, to provide for the payment thereof, and other matters relating thereto. No one appeared, and the matter was closed.
    2. Chairman Horton declared open a public hearing to consider the adoption of an annual operating budget for Spartanburg County for the Fiscal Year 2003-04. No one appeared, and the matter was closed.

Public Health and Human Services Committee (Honorable Johnnye Code Stewart, Chairman)

Personnel and Finance Committee (Honorable Ken Huckaby)

  1. Mr. Jim Hartmann presented an update on meeting with Bond Rating Agencies. Mr. Hartmann and Mr. Al Rickett attended a meeting with Bond Rating Agencies. We received a favorable rating from Moody's, and the other ratings are expected this week.
  2. Mr. Gil Bulman, County Assessor, presented a Reappraisal Update. To date, there have been 8,005 appeals submitted. Some of the appeals will be accepted up until the middle of July. Favorable comments have been received about how well the Reappraisal has been conducted this year.
  3. Updated financial data and personnel vacancy reports were received.

 

Recreation Committee – (Honorable Jeff Horton, Chairman)

  1. Mr. Jeff Caton presented a progress report on our parks. We are moving forward with the completion of Cleveland Park.
  2. Mr. Jesse Campbell, Spartanburg American Legion Post #28, appeared at the May Council Meeting in reference to a request regarding American Legion State Baseball Playoffs. This item was carried forward until June. Motion made by Mr. Adams to assist the American Legion with $2,000. Motion seconded by Mr. Huckaby and carried.

 

Economic Recruitment and Development Committee – (Honorable David Britt, Chairman)

Public Safety and Judiciary Committee – (Honorable Rock Adams, Chairman)

  1. Information received in reference to Home Detention Program. No action was taken. Criminal Justice Coordinating Committee will be meeting again in four or five weeks. Recommendations will be made at a later date.
  2. Mr. Bill Dennis presented information in reference to Fire Department Supplemental Funding. The Fire Protection and Advisory Committee has recommended approval for the use of supplemental funds for FY04. The basic service was for $260,000. Motion made by Mr. Adams to approve the Fire Protection and Advisory Committee's recommendations. Motion seconded by Mr. Huckaby and carried.
  3. Information received regarding activities of the Building Codes Department.

 

Land Use Committee (Honorable David Britt, Chairman)

Public Works, Buildings and Grounds Committee (Honorable Frank Nutt, Chairman

  1. Motion made by Mr. Huckaby to render third reading to an Ordinance pursuant to SC Code §6-1-330 (1976) (as amended) providing for fees and charges for Spartanburg County Parks and Recreation Facilities; providing for a public hearing; providing for the use of the revenue derived therefrom; and providing for adjustment in established fee rates by Resolution of Council. Motion seconded by Mr. Parker and carried. Motion made by Ms. Stewart to reduce the fee for children twelve and under from $1 to $.50 per day for use of the outdoor pools at the Recreation Centers. Motion seconded by Mr. Britt. Mr. Parker stated that when there was no cost the same kids were using the pool constantly. With the addition of $1, you allow the children that have not been able to swim, an opportunity to come. Also, safety should be foremost and paramount in any organization. To provide safe facilities, we need to have adequate chlorine, adequate trained lifeguards on duty, and the opportunity to maintain these facilities. Originally, we reduced the fee from $2 to $1. Ms. Stewart stated that it is our responsibility to maintain the pools. She stated most of the parents of these children would not be able to pay $5 per week. Mr. Nutt stated he would like to see the difference in the figures in charging $.50 versus $1.00. Mr. Hartmann stated additional information could be provided back to Council. This Ordinance does allow for any of the fees to be changed by Resolution in the future. Ms. Stewart asked if there has been a problem with children that cannot get in? Mr. Caton stated that sometimes a number of kids waiting for someone to leave creates a problem for the guard staff. Their focal attention needs to be on the pool. There is a safety concern when the guards are distracted. Mr. Horton called the question. Four opposed. Motion did not carry. Council would still like for this to be reviewed. The fee could be changed later by Resolution.
  2. VIII.

All resolutions, ordinances, agreements, petitions and related documents which were read and approved by Council at this meeting for the financing of certain industrial or similar revenue bonds or notes, are incorporated in these minutes by reference as if fully set forth herein. The reference is to all such documents showing execution by the county on the date of this meeting included in the office of the Clerk of Court for Spartanburg County.

 

IX.

Mr. Hartmann stated that he had been asked to teach an Introduction to Public Administration class at USCS this fall. He also expressed interest in an adjunct teaching position in the Clemson/USC Master of Public Administration program. Although the Clemson program would be in the evenings, the USCS class would be approximately three hours per week during the day. Mr. Hartmann requested Council's authorization to accept teaching positions. It was decided that the Personnel Committee would get together and discuss this request.

Motion made by Mr. Britt to approve minutes of May 12, 2003 (Special Budget Meeting), May 12, 2003 (Work Session), and May 19, 2003 (Regular Meeting). Motion seconded by Ms. Stewart and carried.
