Spartanburg County Council met on Monday, April 19, 2004, in the County Council Chambers, 366 N. Church Street, Spartanburg, SC, at 5:30 p.m. The following attended: Honorable Jeff Horton, Chairman; Honorables Johnnye Code Stewart, Steve Parker, David Britt, Rock Adams, Ken Huckaby, and Frank Nutt, Council Members; along with James K. Hartmann, County Administrator; Glenn Breed, Assistant County Administrator; Chris Story, Assistant County Administrator; and William McBee Smith, Assistant County Attorney.
In compliance with the Freedom of Information Act, notice of this meeting was provided in advance to the local news media and other interested parties.
Chairman Horton called the meeting to order.
Invocation was rendered by Rev. Cathaye Jones, Community New Life Church in Una. Young people involved in the South Carolina Youth Leadership Program from Whitlock Junior High School led in reciting the Pledge of Allegiance.
II.
- Motion made by Ms. Stewart to adopt a Resolution proclaiming April as Fair Housing Month in Spartanburg County. Motion seconded by Mr. Britt and carried. Ms. Elena Rush received the Resolution.
- Motion made by Mr. Parker to adopt a Resolution recognizing the invaluable services provided by the Spartanburg County Communications/9-1-1 Department and proclaiming the week of April 11-17, 2004 as Telecommunicators' Week. Motion seconded by Mr. Huckaby and carried. Mr. David Jones received the Resolution.
- Motion made by Mr. Nutt to adopt a Resolution expressing recognition and appreciation for the pride and honor bestowed upon Spartanburg County by the achievements of Mr. Jimmy Lamb of Spartanburg County Communications/9-1-1 in being named Telecommunicator of the Year. Motion seconded by Mr. Britt and carried. Mr. Jimmy Lamb received the Resolution.

- Mayor Sallie S. Peake, Mayor of Wellford, appeared to introduce three constituents from the Wellford area. Mr. James Brown and Mr. Mike Ramey were present to speak in reference to Roads. Ms. Diane Boyd was present to speak in reference to Parks and Recreation. Mr. James Brown stated that one of their main concerns is that they have seven dirt roads in Wellford, and they have a number of major roads that need to paved and improved that have not been touched in over thirty years. They would like a study of what has been done over the past twenty years in the Wellford community. Mr. Mike Ramey, 290 Jaybird Lane, Wellford, also spoke in reference to his road needing to be paved. Ms. Diane Boyd spoke on behalf of Parks and Recreation in Wellford. Ms. Boyd stated that they have a school building that has broken windows and is a danger. The children have no where to play. Ms. Boyd asked for the building and requested money to go toward Parks and Recreation in Wellford. Chairman Horton asked Mr. Caton to address the issue on the building that was referenced and find out who actually owns the building. A list of the seven dirt roads was submitted. The roads are Suber Drive, Carlock Road, Jackson Street, Dendy Road, Wilkie Road, Blue Spring Circle, Jay Bird Lane, and Pave Ridge Road.
V.
Public Health and Human Services Committee (Honorable Johnnye Code Stewart, Chairman)
- Ms. Elena Rush presented information in reference to the CDBG Consolidated Planning Processes. No action was taken.
- Ms. Elena Rush presented CDBG Grant Funding Recommendations. Motion made by Ms. Stewart to approve the proposed allocation plan as presented with the exception of $17,246 for Animal Allies. Motion seconded by Mr. Huckaby. Mr. Britt made an amended motion to Ms. Stewart's motion that the full request be approved including the $17,246 from Animal Allies based on a number of factors. In the last 40 years, 95% of all fatalities relating to animals have come from unaltered animals. This $17,246 would be going toward spay and neutering in targeted areas that are specifically designated by Ms. Rush's group. Secondly, 80% of all dog bites in the last 40 years have come from unaltered animals. In Spartanburg County, only 30% of our animals have been vaccinated for rabies. Motion seconded by Chairman Horton. Amended motion to approve the funds with the $17,246 for Animal Allies did not carry. The first motion was to approve the block grant minus the $17,246 for Animal Allies. This motion carried. Two opposed. Ms. Stewart stated that she thinks Animal Allies is a worthwhile part of this plan, but she hates to recommend something that will not go to better people. She would rather see the money spent for Parks and Recreation. Mr. Nutt stated that he does not have a problem with Animal Allies either and what they do. Mr. Nutt thinks it is a matter of priorities and recommended looking at our whole process again before this happens next year and make sure everyone knows what they are doing when they approve a plan that lays out how we establish those priorities. Mr. Nutt thinks there are some other projects that maybe should have been in there. We are dealing with roads again. We have roads that have not even been paved.
Personnel and Finance Committee (Honorable Ken Huckaby)
- Updated financial data and personnel vacancy reports were received.
Recreation Committee – (Honorable Jeff Horton, Chairman)
- Mr. Jeff Caton presented a Parks Update. Cleveland Park is coming along nicely. We are still negotiating with a sponsor for a second train. Va-du-mar is moving along nicely also.
Economic Recruitment and Development Committee – (Honorable David Britt, Chairman)

Public Safety and Judiciary Committee – (Honorable Rock Adams, Chairman)
- Sheriff Coffey appeared in reference to Spartanburg County DUI Task Force Grant Application. This was a request for the County to match funds and put four more Officers on staff for DUI enforcement. No action was taken. Council requested that Sheriff Coffey come back at the next meeting and present more information.
- Information received regarding activities of the Building Codes Department.
Land Use Committee (Honorable David Britt, Chairman)
- Mr. Emory Price presented an update from the Land Use Committee meeting held on April 13, 2004. No action was taken.
- Updated Planning Department Reports on Development Activity were received.
Public Works, Buildings and Grounds Committee (Honorable Frank Nutt, Chairman
- Motion made by Mr. Nutt to approve a $17,000 request from Magistrate's Court to purchase and install carpet. Motion seconded by Mr. Huckaby and carried.
- Information received regarding activities of the Public Works Department.
VI.
- Motion made by Mr. Britt to render third reading to an Ordinance finding that Spartanburg Metropolitan Sub-District B may issue not exceeding $500,000 General Obligation Bonds; to authorize the committee for Spartanburg Metropolitan Sub-District B to cause the issuance of such bonds and to provide for the publication of notice of the said finding and authorization. Motion seconded by Mr. Nutt and carried.

All resolutions, ordinances, agreements, petitions and related documents which were read and approved by Council at this meeting for the financing of certain industrial or similar revenue bonds or notes, are incorporated in these minutes by reference as if fully set forth herein. The reference is to all such documents showing execution by the county on the date of this meeting included in the office of the Clerk of Court for Spartanburg County.
IX.
Chairman Horton stated that first reading of our FY05 Budget Ordinance was held earlier today during a Budget Work Session.
X.
Motion made by Mr. Huckaby to approve minutes of March 15, 2004 (Regular Meeting) with an amendment to clarify that the motion carried to appoint Carolyn Brooks to the Spartanburg Memorial Auditorium Commission and to make it clear that the motion did not carry on the nomination to appoint William Monroe to the Health Services District Board. Motion seconded by Mr. Adams and carried.
