Spartanburg County Council met on Monday, January 12, 2004, in the County Council Chambers, 366 N. Church Street, Spartanburg, SC, at 5:30 p.m. The following attended: Honorable Jeff Horton, Chairman; Honorables Johnnye Code Stewart, Steve Parker, David Britt, Rock Adams, Ken Huckaby, and Frank Nutt, Council Members; along with James K. Hartmann, County Administrator; Glenn Breed, Assistant County Administrator; Chris Story, Assistant County Administrator; and Edwin Haskell, Assistant County Attorney.
In compliance with the Freedom of Information Act, notice of this meeting was provided in advance to the local news media and other interested parties.
Chairman Horton called the meeting to order.
Invocation was rendered by Rev. Richard Thomas, Pastor at Mt. Calvary Presbyterian Church in Walnut Grove. Four Boy Scouts led in reciting the Pledge of Allegiance.
II.
- Motion made by Mr. Huckaby to adopt a Resolution expressing recognition and appreciation for the pride and honor bestowed upon Spartanburg County by the achievements of Byrnes High School's Football Team, The Rebels, for winning the 4A Division Two State Championship. Motion seconded by Mr. Adams and carried. Coach Bobby Bentley and several players were present to receive Resolution.
- Motion made by Mr. Adams to adopt a Resolution expressing recognition and appreciation for the pride and honor bestowed upon Spartanburg County by the achievements of Greer High School's Football Team, The Yellowjackets, for winning the 3A State Championship and the Region III 3A Championship. Motion seconded by Mr. Huckaby and carried.
- Motion made by Mr. Britt to adopt a Resolution expressing recognition and appreciation for the pride and honor bestowed upon Spartanburg County by the achievements of Wofford College's Football Team, The Terriers, for winning the Southern Conference Championship. Motion seconded by Mr. Nutt and carried. Coach Mike Ayers and several players were present to receive Resolution.
III.
- Chairman Horton declared open a public hearing to confirm the conveyance by Spartanburg County of the Landrum Health Department property located at 104 East Thompson Street, Landrum, SC to the highest qualified bidder. Said public hearing is to occur at a meeting of the Spartanburg County Council on Monday, January 12, 2004, at 5:30 p.m. at Spartanburg County Council Chambers located in the County Administrative Building at 366 North Church Street in Spartanburg. No one appeared, and the matter was closed.
- Chairman Horton declared open a public hearing to consider the proposed Flood Damage Prevention Ordinance. Mr. Don Bramlett appeared in reference to the proposed Ordinance. Mr. Bramlett lives in the Clifton Community along the Pacolet River. He stated that he does not have a problem with the Ordinance. He feels it is a great thing, but living in a community where there are a lot of rivers and streams, he hopes that as this is implemented affected properties will be taken into account. He hopes that property values will not be decreased because they are on an existing flood plain. He also hopes this will be implemented with an appeals process, so that property values will not be decreased. Mr. Nutt stated that this has been put on us by mandate. We do not have a choice. Mr. Ron Kirby stated that there is an appeals process. In areas that there are any questions about what the flood zones are, appeals are brought to Mr. Kirby's Office. If the party does not like the decision that has been made, it is taken to the Land Management Board of Appeals. From there it can go on to Circuit Court.

Public Health and Human Services Committee (Honorable Johnnye Code Stewart, Chairman)
- Ms. Jennie Thomas, Area Supervisor of the SC Vocational Rehabilitation Department, presented an overview of the activities in and about the Rehabilitation Centers throughout the state for physically challenged people. We have one on South Church Street. Ms. Thomas invited everyone to visit.
- Mr. Roy Johnson, Spartanburg Housing Authority Director, gave a vocal and visual account of what is going on concerning the Phyllis Goins complex. They are applying for funds to revitalize that area. Motion made by Ms. Stewart to adopt a Resolution in support of the Spartanburg Housing Authority's HOPE VI Application. Motion seconded by Mr. Huckaby and carried. One opposed.
Personnel and Finance Committee (Honorable Ken Huckaby)
- Information was received in reference to a request from the Town of Duncan regarding uncollectable personal property taxes on certain abandoned and valueless mobile homes within the Town of Duncan. Motion made by Mr. Huckaby that the County Administrator be authorized to take all actions necessary to abate the delinquent taxes, penalties and interest in the mobile homes in question in accordance with the provisions of 12-49-85 of the South Carolina Code. Motion seconded by Mr. Britt and carried.
- Updated financial data and personnel vacancy reports were received.
Recreation Committee – (Honorable Jeff Horton, Chairman)
- Mr. Stan Tillotson presented an update on our Parks and Recreation Department. Va-du-mar is progressing well. We have received a Federal Grant that we will be utilizing. We have put out bids on Cleveland Park. Hopefully, it will be completed by May of this year.
Economic Recruitment and Development Committee – (Honorable David Britt, Chairman)
- Motion made by Mr. Britt to adopt a Resolution approving the extension by Spartanburg County, South Carolina of a lease agreement by and between Sew-Eurodrive, Inc. and Spartanburg County, South Carolina (Sew-Eurodrive, Inc. Project), pursuant to the provisions of South Carolina Code Annotated, Section 4-12-30 (1976), as amended. Motion seconded by Mr. Huckaby and carried. This is for a two-year extension.
- Motion made by Mr. Britt to abate the taxes currently owed on the Arrow Automotive property. Mr. Britt requested that Administration work with their Attorneys and Orton Company to work out an agreement and an understanding on the clean up process and the abatement of those taxes where we can tie them into performance. Chairman Horton requested an update on this every other month. Motion seconded by Mr. Adams and carried.
Public Safety and Judiciary Committee – (Honorable Rock Adams, Chairman)
- Mr. Mike Padgett presented information in reference to the mobile home amnesty program. This program went into effect a few years ago. To date, 210 mobile homes have been disposed of into the County Landfill. Fourteen mobile homes are pending. Motion made by Mr. Adams to extend this program for three years with an annual report on how it is progressing. Motion seconded by Mr. Nutt and carried.
- Motion made by Mr. Adams to render first reading of an Ordinance to repeal Section 10-92 of County Code (Contractor Billing Application - Ordinance 597). Motion seconded by Mr. Huckaby and carried.
- Information received regarding activities of the Building Codes Department.
Land Use Committee (Honorable David Britt, Chairman)
- Updated Planning Department Reports on Development Activity were received.
Public Works, Buildings and Grounds Committee (Honorable Frank Nutt, Chairman
- Information was received in reference to an opportunity to piggyback with Laurens County to get Aerial Photography and Topographic Mapping of Spartanburg County two years before it is required. We could save over $100,000. Motion made to proceed with this and take the funding out of fund balance to be repaid in a later budget. Motion seconded by Mr. Adams and carried.
- Information received regarding activities of the Public Works Department.

- Motion made by Mr. Britt to render third reading to a Flood Plain Ordinance with the recommended amended language. Motion seconded by Ms. Stewart and carried.
