BASIC FACTS ABOUT FORECLOSURE SALES

THIS IS GENERAL INFORMATION ONLY AND IS IN NO WAY A REPRESENTATION OR WARRANTY CONCERNING ANY ASPECT OF EQUITY COURT SALE. ANY QUESTIONS THAT YOU HAVE SHOULD BE DIRECTED TO A LICENSED ATTORNEY.

  • Sales are held the first Monday of each month at 11:00 a.m. in Magistrate Courtroom #2 on the Fiirst Floor of the Spartanburg County Judicial Center (Courthouse). When the first Monday falls on a legal holiday, the Sale will be held on the next day, Tuesday.
  • Notices of Sale are published in the Spartan Weekly News, the Hometown News or the Spartanburg Herald-Journal for three (3) consecutive weeks preceding the Sale. BE SURE TO READ THESE ADS CAREFULLY TO DETERMINE WHICH PROPERTY MAY BE OF INTEREST TO YOU.
  • In addition to the published Notices of Sale, the Master’s Order of Judgment and Foreclosure for each property to be sold that month is available for viewing on our website at www.spartanburgcounty.org. Click on the Master-in-Equity link under our website and there will be another link that reads “Current Property to be Sold”, click on that and it will let you view each property individually. The terms of the Order are controlling over all other information. Each property is usually sold subject to past due taxes, liens, senior encumbrances, restrictions and easements of record, if any.
  • If you are the successful bidder at the Sale, you will be required to deposit five percent (5%) of your bid in cash or certified check at the time your bid is accepted. As a general rule, you know how much you are willing to bid for the property in which you are interested. IF YOU DO NOT HAVE THE REQUIRED FIVE PERCENT (5%) WITH YOU, DO NOT BID.
  • Some Plaintiffs seek a deficiency judgment against the Defendant(s). This means a money judgment is being sought in addition to foreclosing the mortgage. The bidding will remain open for thirty (30) days from the date of the Sale. On that date, the re-bid date, the property is offered for sale again and the highest bid is accepted. The Plaintiff and/or the highest bidder at the Sale may not bid on the re-bid date.
